Applicant, David Maddux of The Arcus Group Inc. for property owner Jack Griffiths of JNLM5, LLC , proposes to construct a garage addition on the front of the house, an extension on the side of the house, and an addition including an unroofed patio deck at the second-floor level on the rear of the house. Three variances are required as proposed, one to reduce a side yard to less than 10 ft, the second to reduce the combined side yard total to less than 25 feet, and the third to construct an unroofed patio deck that is greater than 300 square feet above the first-floor elevation. Property is located in the R1L-Residential Single Family Low-Density District.

Variance 1: Request a variance reduce side yard setback to 8 foot 6 as proposed, the requirement is a minimum of 10 feet in the R1L district.  Pursuant to ordinance 1121.07 Minimum Yard Requirements for Principal Buildings (Ord. 91-95. Passed 10-7-1996.)

Variance 2: Request a variance reduce the combined setback total from 25 feet side as proposed, the requirement is a minimum of 25 feet in the R1L district. Pursuant to ordinance 1121.07 Minimum Yard Requirements for Principal Buildings (Ord. 91-95. Passed 10-7-1996.)

Variance 3: Request a variance to construct a 521 square foot unroofed patio deck 8 feet 10 inches above the first floor on the rear of the home, as proposed, the requirement prohibits an unroofed patio deck greater than 300 square feet to be constructed above the first floor elevation in the R1L district.   Pursuant to ordinance 1121.03(d) Permitted Accessory Uses (Ord. 24-98. Passed 5-18-1998.)
